Agreement to Terms

By accessing or using Appointa's website and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

Description of Service

Appointa provides an AI-powered scheduling assistant that helps businesses manage appointments through automated SMS text message conversations. Our service integrates with your existing scheduling tools to handle booking, rescheduling, cancellation, and reminder messages on your behalf.

SMS/Text Messaging Terms

Appointa powers SMS-based scheduling on behalf of the businesses that use our platform. The following terms apply to text messaging through our service:

  • Conversational messages: When you text a business using Appointa, our AI responds on that business's behalf to assist with appointment scheduling. These messages are sent in direct response to texts you initiate.
  • Automated messages: When you book an appointment, you may receive automated transactional messages such as confirmations and reminders related to your scheduled appointment.
  • Message frequency: Message frequency varies based on your appointment activity.
  • Message and data rates: Message and data rates may apply. Contact your mobile carrier for details about your text messaging plan.
  • Opt-out of automated messages: You may opt out of automated reminders and confirmations at any time by replying STOP to any message. You may also reply CANCEL, UNSUBSCRIBE, END, or QUIT. After opting out, you will receive one final confirmation message. You may still text the business and receive responses to conversations you start.
  • Help: Reply HELP to any message for assistance, or contact us at support@appointa.ai.
  • Supported carriers: Appointa's SMS program is supported on all major US mobile carriers. Carriers are not liable for delayed or undelivered messages.

Beta Service

During the beta period, the service is provided free of charge. Beta services may be modified, suspended, or discontinued at any time. We make no guarantees about service availability or functionality during the beta period.

User Responsibilities

When using our services, you agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Use the service only for lawful purposes
  • Not attempt to interfere with or disrupt the service
  • Comply with all applicable laws regarding electronic communications, including the Telephone Consumer Protection Act (TCPA) and applicable state regulations
  • Obtain proper consent from your clients before enrolling them in SMS-based scheduling through Appointa

Intellectual Property

The Appointa service, including its design, features, and content, is owned by Appointa and protected by intellectual property laws. You may not copy, modify, or distribute our materials without permission.

Data and Privacy

Your use of Appointa is also governed by our Privacy Policy, which describes how we collect, use, and protect your data, including mobile phone numbers and SMS opt-in information.

Third-Party Integrations

Appointa integrates with third-party scheduling platforms and uses third-party messaging services to deliver SMS messages. Your use of those platforms is subject to their respective terms and conditions. We are not responsible for the availability or functionality of third-party services.

Limitation of Liability

To the maximum extent permitted by law, Appointa shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the service. This includes, but is not limited to, damages arising from delayed or undelivered SMS messages, scheduling errors, or service interruptions.

Disclaimer of Warranties

The service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the service will be uninterrupted, error-free, or meet your specific requirements. We do not guarantee the delivery of any SMS message, as delivery is dependent on mobile carrier networks outside of our control.

Modifications to Terms

We may update these terms from time to time. Continued use of the service after changes constitutes acceptance of the new terms. We will notify users of significant changes via email or through the service.

Termination

We may suspend or terminate your access to the service at any time, with or without cause. Upon termination, your right to use the service will immediately cease. You may terminate your use of the service at any time by opting out of SMS messages (reply STOP) and discontinuing use of the platform.

Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law provisions.
